OWNERS' OPERATING AGREEMENT FOR WAILEA EKAHI UNIT __________
- This Agreement is being executed by all of the current Owners, (the "Owners"), of Apartment ____ at Wailea Ekahi, (the "Apartment"), in compliance with Article 10(a) (iii) of the Declarations of Condominium Property Regime for Wailea Ekahi.
- Owners appoint,_______________________, being one of the Owners signing below, as the Managing Agent for the Apartment with whom the Board of Directions of the Association of Apartment Owners of Wailea Ekahi or the project General Manager will communicate on all Association matters and to whom all notices with respect to the Apartment may be sent
- including, but not limited to, notice with respect to Association meetings and delinquencies - which communications and/or notices shall be deemed notice to all of the Owners.

If at any time during the term of this Agreement the mailing address or telephone number for the Managing Agent shall change, the Managing Agent shall immediately inform the project General Manager of the new address or telephone number; provided, however, all communications mailed to the Managing Agent at the most recent address on file in the office of the project General Manager shall be sufficient and adequate notice to the Owners for all purposes.
- Owners acknowledge and confirm that this Agreement must be updated and re-signed
by the current Owners upon any change in ownership of the Apartment or any change in the identity of the Managing Agent.
- Owners acknowledge and confirm that the project General Manager, the Board of Directors of the Association and the employees of the Association shall be entitled to rely on the accuracy and validity of this Agreement and/or any notification(s) of a change in the address or telephone number of the Managing Agent for all purposes related to the official business of the Association.
- This Agreement takes effect upon execution by the Owners and the delivery of this Agreement to the office of the General Manager either by hand delivery or by certified mail return receipt requested.
